40 year old Charles Rodriguez Sr. of North Spruce Street was arrested this morning after being accused of leaving a one year old child in his apartment unattended.

Batavia Police went to his residence last night to question Rodriguez in regards to an investigation of a petit larceny at Dollar General last Tuesday.

Rodriguez was nowhere to be found however there was a light on and a television could be heard.

A concerned citizen informed officers there was a one year old child alone in the apartment and with the assistance of the

Batavia City Fire Department one of the officers climbed a ladder into a second story window to rescue the child.

The abandoned baby was found awake in a crib in the 85 degree apartment.

Investigation revealed the child’s mother had apparently left him in charge of the infant for the night while she went to Buffalo.

Rodriguez was arraigned on the charge of Endangering the Welfare of a Child which he pled guilty to and was sentenced to six months in the Genesee County Jail.

He also pled guilty to the initial Petit Larceny charge which his sentence will run concurrent with.
