Genesee County Court has handed down sentencing for its first Felony DWI under the full Leandra’s Law.
Joshua Garcia, of Erie County, was arrested back on December 20th and charged with Felony DWI. Today, he was sentenced for that crime. Garcia will pay a fine and go on probation.
And – under Leandra’s Law – he must now install an ignition interlock breathalyzer on every vehicle he may drive.
For Garcia, that’s apparently only one vehicle. Anyone who drives that car will now have to blow into the device before turning the car on. If the interlock detects alcohol on the driver’s breath, the car will not start.
Garcia will have to pay about $100 a month to maintain the device. It must be installed within the next ten days.
