The former Alabama man currently serving a 21-year prison sentence on child molestation charges will not have a second trial.

District Attorney Lawrence Friedman made a motion today which was approved by Judge Robert Noonan to drop all remaining charges on 42-year-old Earl Sprague III.

He was facing a possible trial on several burglary and sex abuse charges.

Friedman told our news partner The Batavian, "We made a determination we couldn't really proceed with the remaining charge. That's all I can really say."

Sprague was convicted of 28 counts of sexual abuse by jury trial in December.
