A man whose DNA was indicted before the statute of limitations ran out on several 2008 Batavia burglaries will have more time before he learns more about his fate.

27-year-old Samuel Malone of Walnut Street, Batavia, was offered a plea deal on charges of third-degree burglary and third-degree attempted burglary. However, potential new evidence surfaced of another alleged crime. The District Attorney’s Office was granted an adjournment before finalizing a plea agreement.

Malone is out of jail on supervision and is schedule back in county court the 18th.
