The veteran Niagara County Sheriff’s deputy who is accused of getting into a scuffle with a concert goer at Darien Lake this past summer pleaded not guilty – again – to a second-degree assault charge yesterday in County Court.
The charge has been upgraded twice against Kelly Alcorn from misdemeanor harassment up to the current class D felony, and each time she has pleaded not guilty. A Genesee County Grand Jury indicted her this month on the charge claiming that she pushed Elizabeth Dake into a cinder block wall.
The 20-year law enforcement veteran is currently suspended without pay. She is released on her own recognizance since her arrest.
