In Genesee County Court today...
An Oakfield man facing four felony charges related to driving while intoxicated was sentenced to 1 1/3 to 4 years in state prison. This sentence will run concurrent to his violation of probation sentence.
Walter Hale Jr., 34, was charged in an August incident under Leandra’s Law for allegedly driving while intoxicated with three children in the car. He was stopped on Route 63 by State Police where he failed a field sobriety test with a .09 BAC.
Also the sentencing for 24-year-old Randy Johnson – the Batavia man who pleaded guilty in November to a single felony count of reckless assault of a child -- was adjourned to March 14 at 10:15.
The Walnut Street man was accused in September of violently assaulting an eight-month-old baby which caused it to be hospitalized due to head injuries.
Judge Robert Noonan said he needs more information, either from the treating physician or an expert in shaken baby syndrome to provide additional information on what kind of action to the baby could have produced "such a serious medical outcome".
Following the baby’s release from the hospital last year, it was placed in the custody and care of Child Protective Services.
