A settlement in the wrongful death lawsuit filed against Darien Lake Theme Park by the family of Sgt. James Hackemer has been reached.

The double-amputee Iraq veteran was killed when he fell out of a roller coaster in July 2011. State officials deemed operator error the cause of the death. Hackemer fell 150 feet to the ground from the Ride of Steel coaster.

The exact amount isn’t being released, but it believed to be seven-figures. Lawyers say Hackemer’s two young daughters will be the beneficiaries.

Hackemer lost both of his legs in a roadside bomb incident.

He was 29.
