Testimony in the trial of Jacquetta Simmons will begin Wednesday morning in Genesee County Court. Jury selection was completed Tuesday afternoon.
A panel of 10 women and two men, all white, will hear the evidence in the case. Three additional people were selected as alternate jurors.
All were asked if they had formed any opinions about the case and if race or age would be a factor in their deliberations. All 12, along with the alternates and answered no.
The 26 year old Simmons of Batavia faces a felony count of assault under New York State’s "Granny Law" and a lesser misdemeanor charge of assault in the third degree. Simmons is accused of punching a 70-year-old cashier at the Batavia Wal-Mart on Christmas Eve.
