A man convicted of second-degree rape in Wyoming County, then married here in Genesee County, but living in West Virginia...has been arrested and brought back where he started from.
25-year-old Eric Motzer, alias Eric DiSalvo, is in the Wyoming County Jail today without bail.
According to Wyoming County Sheriff’s Deputies, Motzer was found guilty of second-degree rape and second-degree criminal sexual act in September 2011 at jury trial. He was bailed out of jail before sentencing.
Then, Motzer didn’t show up for the sentence.
He was tracked down two weeks later in Clay County, West Virginia. But, Motzer claimed, his name wasn’t Eric Motzer – he had married, he said, and the name was now Eric DiSalvo.
A check of the records confirmed: Motzer had been married in Genesee County, one day before criminal sentencing, and had legally changed his name to Eric DiSalvo, after he’d been married and legally changed his name.
But, deputies maintained, a name change does not change the person.
It took a lengthy extradition process of over four months, but Motzer, or DiSalvo, eventually waived extradition rights.
Motzer, or DiSalvo, will now be sentenced on April 5th.
